Asbestos in pre-2000 homes

Does buying an owner-occupied house require an asbestos management survey?

No. An asbestos management survey is a duty for some non-domestic premises and for common parts in some blocks. Buying a house to live in does not, by itself, trigger that duty. You still should not disturb suspect materials, and a home survey will not have sampled them.

What is the fuller explanation?

HSE explains where dutyholders must manage asbestos. A homeowner decorating their own house is not the same legal role as an employer controlling a workplace. Flats can be different: common boilers, service risers and corridors may be managed by someone else. Ask the managing agent if you are buying a flat. Do not assume the flat survey included the riser.

If you will refurbish, the right extra is the survey that fits those works, often called a refurbishment or demolition survey. Commission it when the works are real. Ask the firm which type they are selling you. The fee is theirs. The home survey’s “possible asbestos” line is the flag, not the management file.

What should you ask your surveyor?

  • Are you describing a house, or common parts of a block?
  • Which materials would a management survey cover that you did not sample?
  • Did you enter the risers, the boiler cupboard and the garage?

What are the typical next steps?

  1. Do not buy a commercial management survey you do not need just to feel covered.
  2. Do commission sampling if your works will disturb a suspect material.
  3. In a flat, ask the agent for any asbestos record for the common parts. Absence of a record is information too.

Costs vary with the building and with who you instruct. Where this page does not cite a published figure, ask the surveyor, a relevant specialist, or your solicitor for a written quote. Do not treat a forum average as the price.

Does a buy-to-let change the duty?

Letting can change legal duties, including gas and electrical rules. Asbestos duties depend on what is being managed and by whom. Ask a competent adviser if you will let the property. Do not treat this page as that advice.

Will the lender insist on an asbestos survey?

Ask the lender. Many will not, for an ordinary house. Do not invent a condition.
