Drainage and septic tanks
Who is the operator of a shared septic tank under the English guidance?
The guidance says you are responsible if you own a property that uses the system, and that if you share the system you are jointly responsible. A tenancy can also place responsibility by agreement. A home survey does not decide the share. The solicitor and the paperwork do.

What is the fuller explanation?
Joint responsibility means a neighbour’s neglect can become your problem, and yours theirs. Ask whether there is a deed, a maintenance account or only a habit of splitting the emptying bill. Habit is weak when someone sells. Get the arrangement disclosed before exchange. The English page is the source of the operator definition used here. Other nations may define it differently.
The surveyor may see two houses and one cover. They cannot see the deed. Tell them if you already know it is shared so they look at access and condition. Then tell the solicitor. Emptying costs are the contractor’s price. There is no official annual charge to print. Ask the firm that last emptied it, if the invoice can be found, what they charged that day. That is history, not your future contract.
What should you ask your surveyor?
- Did the layout suggest a shared system, or did you see a tank that serves this house only?
- What condition issues would still matter if the legal share is someone else’s to arrange?
- Could you get access to the cover?
What are the typical next steps?
- Ask the solicitor for the deed or the absence of one.
- Ask the seller for emptying invoices and who paid them.
- If there is no agreement, decide whether you will buy that uncertainty. The survey cannot paper over it.
Costs vary with the building and with who you instruct. Where this page does not cite a published figure, ask the surveyor, a relevant specialist, or your solicitor for a written quote. Do not treat a forum average as the price.

Does joint responsibility mean you pay half of every replacement?
Not automatically. The deed or the law on that system decides the split. Do not assume half. Ask the solicitor.
Can you build over the shared tank?
Do not. Access for emptying matters, and the neighbour has an interest. Ask the solicitor and a drainage engineer before you draw an extension on top of it.
