What should a survey of a leasehold flat cover?

A flat survey rates the parts of the building the surveyor can see. It does not read the lease. Who repairs the roof, what the service charge covers, and how many years are left on the lease are legal questions for your solicitor. A condition rating on a shared wall is a building fact. It is not a bill split.

Last reviewed 24 October 2026. Written for buyers in England and Wales unless a source says otherwise. No named surveyor has signed this page. It is general guidance, not a report on your house, and not legal advice.

What can the surveyor actually inspect in a flat?

The instruction is still a RICS Home Survey at the level you bought. The difference is access. The surveyor can report on the flat itself and on the outside of the block from places they can safely reach. They do not have a right to enter the flat above, the plant room, or a locked roof just because you are buying.

A top-floor flat makes the roof more of your problem in practice, and less of something they may be able to see. A ground-floor flat makes the shared hallway, the damp-proof course and the outside ground levels easier to look at, and the roof more remote. The report should say what was not inspected. NI on a shared element is a gap, not a pass.

Why does the lease sit outside the condition ratings?

Condition ratings describe defects. The lease describes obligations. A rating 3 on a roof covering means the surveyor thinks the covering needs urgent repair, replacement or investigation. It does not say whether that cost falls on you, on a service charge, or on a landlord who may then recover it. Your solicitor reads the lease. The surveyor should not guess the split.

Share of freehold does not delete this. It changes who sits on the freeholder side. It does not turn the survey into a set of accounts, and it does not make a defect cheaper.

How should you read a Section 20 notice next to a survey?

GOV.UK explains that if you pay a variable service charge you have a right to be consulted about some charges, in steps landlords call a Section 20 consultation. The published thresholds, reviewed on 24 October 2026, are more than £250 for planned work and more than £100 a year for work and services lasting more than 12 months. If consultation was not done properly, GOV.UK says there is a limit on what you can be asked to pay, and points you to the Leasehold Advisory Service.

A survey might be the first time you hear that the roof needs work. A Section 20 notice might be the first time you hear what the landlord plans to charge. They are different documents. Neither is a quote you should treat as final, and this page does not turn the thresholds into a repair price.

Does a short lease or a ground rent show up as a defect?

No. Years left on a lease are not a condition rating. A peppercorn is not a rating 1. The Leasehold Reform (Ground Rent) Act 2022 stops ground rent above a peppercorn on most new long residential leases granted from 30 June 2022 in England and Wales. The Act says a peppercorn rent means an annual rent of one peppercorn. It does not cancel ground rent on leases that were already granted, and GOV.UK lists exceptions, including some business leases and community-led housing.

Statutory lease extensions were outside that reform as GOV.UK described it. If someone tells you every flat in England now has zero ground rent, they are ahead of the statute. Ask your solicitor what this lease actually reserves.

Common questions

Are Level 1, 2 and 3 defined differently for flats?

No. The RICS levels are the same products. What changes is how much of a block a visual inspection can reach, and how much advice you have bought. A converted house or a block with odd alterations is a reason to talk about Level 3 before you instruct, not a rule this page can impose.

The housing association valued the flat. Do you still want a survey?

A valuation for a share, a rent, or a lender is not a condition report. MoneyHelper’s description of a mortgage valuation, on a different page of this site, is the same idea: price is not structure. If you want defects described, instruct a survey. The association’s figure does not do that job.

If the block has cladding, does the survey grade it?

Only to the extent a visual home survey can. The surveyor can see the outside face and record concern. They do not open the wall, and they do not issue a building-safety certificate. GOV.UK’s leaseholder protections are a legal question about certain costs. Ask your solicitor whether this lease is in that regime. Do not treat every panel as a rating 3 because the word cladding appeared in a forum.

Will the surveyor check the service-charge accounts?

No. Accounts, sinking funds and planned works are papers. GOV.UK says you can ask for a summary of how a service charge is worked out. That request sits with the landlord or the managing agent, via your solicitor, not in the surveyor’s moisture meter.

Can the surveyor inspect the roof above a top-floor flat?

Only if there is safe access within the inspection they agreed. A loft hatch inside the flat lets them see the roof structure above that flat, not the whole block. A locked hatch is NI, or a limit, not a statement that the covering is sound.

Does share of freehold mean you can ignore the outside of the block?

No. It may mean you and the other owners control the freehold. The brick, the roof and the drains still fail or they do not. The survey is about that fabric. The company minutes are about whether anyone is planning to fix it.

Is damp more serious in a ground-floor flat?

It is more often visible there, because the floor is on or near the ground. Seriousness is the rating and the paragraph, not the storey. A basement room with no ventilation is a different problem from a stain under a kitchen sink. Read which one they described.

The survey suggests opening a wall. Can you?

Not from the survey. Alterations in a flat usually need the landlord’s consent under the lease, and sometimes building regulations or listed building consent as well. The survey can say a wall looks loadbearing or that it could not tell. It cannot grant a licence to alter.

Key facts

What the survey rates
Elements the surveyor could inspect, using the same condition ratings as a house. Access to roofs, risers and other flats is often limited.
What the survey does not decide
The lease, who pays, the years left, or whether you qualify for a building-safety leaseholder protection. Those are legal questions.
Section 20
GOV.UK says leaseholders who pay a variable service charge have a right to be consulted above £250 for planned work, or £100 a year for services lasting more than 12 months. Reviewed 24 October 2026. Those are consultation thresholds, not repair quotes.
Ground rent on many new leases
The Leasehold Reform (Ground Rent) Act 2022, in force from 30 June 2022, limits ground rent on most new long residential leases in England and Wales to a peppercorn. Older leases are not rewritten by that sentence. Exceptions exist.
Building safety
GOV.UK publishes leaseholder protections for certain building-safety costs. A condition rating does not decide if a lease qualifies.
