What is a party wall, and when does the Act apply?
In England and Wales the Party Wall etc. Act 1996 sits apart from planning permission and building regulations. It covers building on or at a boundary, work to a party wall or party structure, and excavation near a neighbour’s foundations. Notice is given between two months and a year before the work. A condition rating is not an award.

What counts as a party wall?
GOV.UK describes a party wall as a wall that stands on the land of two owners and forms part of a building, or a wall that separates buildings of different owners. A party structure can be a floor between flats. A garden fence is not the subject of this page. The Act is about certain building works, not about every disagreement with a neighbour.
When do you have to tell the neighbour?
When the work is the kind the Act covers: building on or at the boundary, cutting into or altering a party wall, or excavating near and below their foundations. GOV.UK says notice is served between two months and a year before you intend to start. The neighbour can agree or disagree. If they disagree, the Act sets out how the dispute is resolved. That process is not the same as your home survey, and this page does not describe fees for party-wall surveyors because GOV.UK’s guide is the place to read the procedure rather than a price list.
- Building a new wall on or astride the boundary.
- Cutting into a party wall, or raising, lowering or rebuilding it.
- Removing a chimney breast from a party wall.
- Excavating near and below the neighbour’s foundations.
What does a home survey have to do with the Act?
Almost nothing formal. The surveyor may see that a loft was cut into a party wall, or that a neighbour’s extension sits on the boundary, and they should tell you to ask your solicitor. They do not serve notice, and they do not write an award. A condition rating 3 on a shared wall is about condition. It does not appoint anyone under the Act.
What should a buyer ask the solicitor?
Whether work the survey describes, or work you can see, needed notice, and whether any award or letter of consent exists. Also whether you will be the person who must cooperate if the neighbour builds later. Planning permission in a drawer does not answer the party-wall question. GOV.UK is explicit that the regimes are separate.
Common questions
Does the Party Wall etc. Act apply in Scotland?
GOV.UK’s party-wall guidance is for England and Wales and says the rules in Scotland are different. Do not serve an English notice on a Scottish neighbour because this page described the Act. Take local advice.
The seller says the neighbour was fine with it. Is that notice?
A conversation is not the written notice the Act describes. Your solicitor should look for the paperwork. A friendly neighbour can move house. The Act exists so the next owner is not relying on a chat.
What is a party-wall award?
It is the written resolution the Act provides when owners do not simply agree. It is not a RICS Home Survey and not a planning consent. If one exists, read who it binds and what work it described. This page is not a substitute for reading it.
Does a loft conversion need the Act?
If the work cuts into or bears on a party wall, GOV.UK’s list of examples includes that kind of work. Not every loft does. Ask the solicitor to compare the drawings with the Act, not with the brochure.
We are only digging for a drain. Does the Act apply?
It can, if the excavation is near and below the neighbour’s foundations. Depth and distance are set out in the official guidance. Do not guess from this summary. If the survey mentions deep excavations beside the boundary, flag them to the solicitor.
Who pays the party-wall surveyors?
The Act and the award deal with costs. This page does not quote a fee. Do not budget from a forum. If an award exists, it may already say who paid.
The neighbour is objecting. Does that stop the purchase?
It means there is a live dispute under a procedure. Whether you still want the house is your decision, with your solicitor. A survey cannot settle it. Do not exchange on an assurance that it will “blow over” unless you are happy to own the argument.
The party wall is cracked. Is that an Act matter or a repair?
The crack is condition, which the survey describes. Who must repair a shared wall, and whether works to it need notice, is legal. You may need both a builder’s view of the crack and a solicitor’s view of the wall. They are not the same visit.

- Notice
- GOV.UK: give notice between two months and a year before the planned start.
