Age and type of house

Does a crack on a party wall mean the surveyor has made a Party Wall Act award?

No. GOV.UK’s party wall guidance is about notices and disputes when someone does certain work on or near a shared wall. A home survey does not serve those notices and does not appoint a party wall surveyor. A crack the surveyor records is a condition comment. Any award that already exists is a paper your solicitor asks for.

What is the fuller explanation?

Buyers mix three jobs: the condition of the wall, the legal process for future building work, and a neighbour dispute that may already be underway. The survey does the first, and only as far as it can see. It does not write to the neighbour. It does not decide who pays for a crack that crosses the boundary.

If you plan to remove a chimney breast or extend along the boundary, the party wall process may apply later. That is advice from a party wall surveyor and your solicitor at the time of the work, not a paragraph you can lift from today’s home survey. In Scotland the Act is not the English one. Ask a Scottish solicitor which rules apply.

What should you ask your surveyor?

  • Are you describing condition, or are you giving party wall advice?
  • Did the crack appear to continue into the neighbour’s side, or could you not tell?
  • What paper, if any, should the solicitor ask the seller for?

What are the typical next steps?

  1. Ask the solicitor whether any award, letter or neighbour dispute has been disclosed.
  2. Do not send the neighbour a notice yourself because a survey mentioned the wall.
  3. If you intend to alter the wall after purchase, take party wall advice then, on the work you actually propose.

Costs vary with the building and with who you instruct. Where this page does not cite a published figure, ask the surveyor, a relevant specialist, or your solicitor for a written quote. Do not treat a forum average as the price.

Does the Party Wall Act apply in Scotland?

The English Act does not. Ask a Scottish solicitor what applies to a shared wall there. Do not paste the English notice rules into a Scottish purchase.

Is a party wall survey the same product as a Level 2?

No. A party wall surveyor is instructed under that process. A Level 2 is a condition survey of the home.
