After the survey

When can you walk away after a home survey?

A survey does not order you to withdraw. RICS says that for a condition rating 3 you should obtain written quotations before you are legally committed. If you are not committed, you can still ask, renegotiate, or decide against the home. If you have exchanged, or you bought at auction, ask your solicitor before you assume you can leave.

Last reviewed 24 October 2026. Written for buyers in England and Wales unless a source says otherwise. No named surveyor has signed this page. It is general guidance, not a report on your house, and not legal advice.

Does a rating 3 mean you should walk away?

No. The published definition is serious defects, or urgent repair, replacement or investigation, and a prompt to get written quotes before you are legally committed. Some rating 3 items are a single trade and a clear price. Some are a reason you no longer want the house. The paragraph, and the quote or specialist report that follows, is how you tell them apart. The renegotiation guide walks that without turning it into a script.

A stack of rating 2s can be a larger bill and still not be ‘urgent’ in RICS’s words. Walking away over maintenance you were happy to accept last week is a change of mind, which you may be free to have. It is not what the rating requires.

What does ‘before you are legally committed’ mean?

In a typical private treaty purchase in England and Wales, people talk as if exchange is the moment you are bound. That is the usual pattern and not a description of your file. New-build reservation agreements, options, and auctions can bind earlier. Scotland’s missives are a different sequence. The only honest instruction from a survey website is: ask the solicitor who can see the papers, and ask before you spend money assuming you can withdraw.

While you are free to withdraw, you are also free to wait for the quote RICS mentioned. Waiting is not weakness. It is the sentence on the rating.

Which reasons for leaving are the survey, and which are yours?

The survey contributes facts: this element is serious, this one was not inspected, this one needs a specialist. You contribute the rest: you will not live with a house that needs that investigation, or you will. A damp note you do not understand is a reason to ask, not yet a reason to leave. A structural note the surveyor says needs an engineer before commitment is a reason to pause. If the seller refuses access for that engineer and you would not buy blind, leaving is coherent. If you would buy anyway, say so, and do not perform a negotiation you do not mean.

Nobody on this website has seen the house. That is why there is no red button.

What about the survey fee and other costs if you withdraw?

The survey fee is the price of the information. It is not refundable because the news was unwelcome, unless the firm failed to do what it was instructed to do. Other costs, such as legal fees already incurred, or a reservation fee, depend on those contracts. This page will not tell you they come back. Ask the people you paid.

Do not stay in a purchase you have decided against solely because the survey fee feels wasted. Also do not leave because a forum told you every rating 3 is a walk-away. Both are moods. The report is a document.

Common questions

The seller will not let a contractor in. What then?

Then you do not have the quotation RICS suggested you obtain. You can decide without it, or you can say you will not exchange without it. If you are not yet committed, both are available. The seller does not have to cooperate. Your solicitor explains the consequence of waiting.

You are buying at auction. When is the survey useful?

Before you bid, if a bid would bind you. After the hammer, a survey can still explain the building, and it may be too late to walk away. Ask your solicitor which auction conditions apply. Do not discover them from this paragraph.

Can you walk away from a new build after snagging?

Only if your contract still allows it. Snags are often remedied by the builder after completion, under the warranty described on the new-build page. A serious concern is different from a scratched worktop. The reservation agreement is the document, not the snagging list.

One of you wants to leave and the other does not.

The survey will not vote. Write down the item you disagree about, the rating, and whether a quote would settle it. If a quote would settle it, get the quote. If the disagreement is about whether you want the house at all, that is not a surveying question.

Is walking away the same as gazundering?

No. Gazundering is a price cut pressed late. Walking away is leaving the purchase. Renegotiating is a third thing, covered in the renegotiation guide. Using a survey as a pretext for a cut you always planned is a commercial choice. It is not what the condition rating says.

The loft is NI. Should you withdraw?

NI means not inspected. Withdraw only if the hidden part is one you are unwilling to buy unseen, and you cannot arrange an inspection before commitment. A locked hatch you can get opened next Tuesday is a delay, not a principle.

Your solicitor says the contract is already binding. Can the survey undo it?

No. A survey does not rescind a contract. If you have exchanged, the remedies are the ones in that contract and in law, which your solicitor explains. Read the report so you know the building you are now committed to. Do not read it as an exit.

Is there a checklist that decides for you?

There is a question flow on this site. It sorts rating 3, quotes, and whether you are committed. It ends in sentences, not a score, and it tells you when the next person to speak to is the solicitor or the surveyor. It does not decide.

Key facts

What RICS tells a buyer
For condition rating 3, obtain written quotations before legal commitment. That is in the rating definition they publish. It is not an instruction to withdraw.
What this page will not do
It will not score the report, name a percentage to ask off, or tell you the purchase is a mistake.
Commitment
Exchange of contracts, some auction purchases, and some reservation agreements are not the same moment. Your solicitor knows which document you signed.
A decision tool
There is a separate question flow that sorts these points. It still refuses to invent a number.
