Renegotiating or walking away
Can you walk away before exchange if the survey is worse than you hoped?
In England and Wales you are usually free to withdraw before exchange of contracts, but a reservation agreement or a lock-out agreement can change that, and you may already have spent money you will not get back. After exchange you are generally bound. Your solicitor reads what you signed. The survey does not cancel a contract by existing.

What is the fuller explanation?
Searches, survey fees and legal fees are usually yours whether you proceed or not. A seller’s disappointment is not a bill, unless you agreed something that makes it one. Read the reservation form. In Scotland the process is missives, and “before exchange” is the wrong phrase. Ask a Scottish solicitor before you assume you can walk.
Walking away is a valid outcome when the building is not the one you thought, or the unknown is larger than you will carry. It is not a moral failure and it is not a bargaining trick you are obliged to use. Decide with the report, the quotes and the contract. RICS does not publish a list of defects that require withdrawal.
What should you ask your surveyor?
- Which findings are serious enough that a buyer might reasonably reconsider?
- Which findings are ordinary maintenance I should not dress up as a reason to withdraw?
- What investigations would still be open if I stayed?
What are the typical next steps?
- Ask the solicitor whether you are free to withdraw, before you tell the agent you are gone.
- If you withdraw, do it clearly and once.
- Do not use a fake deadline. The real deadline is the one the solicitor names.
Costs vary with the building and with who you instruct. Where this page does not cite a published figure, ask the surveyor, a relevant specialist, or your solicitor for a written quote. Do not treat a forum average as the price.

Do you lose the survey fee if you walk away?
Yes. You paid for the report. It is yours. It is not refundable because the news was bad, unless the firm’s terms say something unusual.
Can the seller keep your holding deposit?
If you paid one, the agreement says. Ask the solicitor. There is no universal answer.
