An Article 4 direction is mentioned and the front windows are already plastic. Does the survey decide whether consent was required for that swap?
No. The survey does not decide whether consent was required for the swap to plastic windows. An Article 4 direction is a planning control. The surveyor can record that the front windows are plastic, and can comment on their condition, their fit and any damp at the openings. Whether that replacement needed consent, and whether any consent exists, is for the planning record and your solicitor. Do not ask the condition rating to sit as a planning decision.

What is the fuller explanation?
Article 4 is the council removing freedoms that would otherwise let some work go ahead without an application. Buyers hear the phrase and want the surveyor to say the plastic windows are either lawful or a breach. The inspection was not that enquiry. It looked at what is there now. A rotten timber window and a neat plastic one are different condition facts. Neither fact answers whether the replacement was caught by the direction.
Give the solicitor the mention of Article 4 and the fact of the plastic fronts, and ask them to check the direction and any consent. Keep the survey for how the windows perform: draughts, failed seals, poor junctions, or a frame that is already failing. Do not deduct a sum, or relax, because you have decided the legal question yourself from a sentence in the report. The survey has not held that hearing.
What should you ask your surveyor?
- What condition comments apply to the plastic windows as they stand?
- Are you making any finding about whether consent was required?
- Which window defects are urgent regardless of the Article 4 question?
What are the typical next steps?
- Ask the solicitor to check the Article 4 direction and any window consent.
- Use the survey for the condition of the windows that are there now.
- Do not treat a condition rating as a ruling on the swap.
Costs vary with the building and with who you instruct. Where this page does not cite a published figure, ask the surveyor, a relevant specialist, or your solicitor for a written quote. Do not treat a forum average as the price.

If the windows look new, can you assume they were consented?
No. Newness is not consent. The survey can describe the plastic windows. Whether Article 4 meant an application was required is a planning question for the solicitor.
Can the surveyor tell you to replace them again before exchange?
No. The survey does not order a further swap, and it does not decide the consent. Condition and planning control stay separate.
