Renegotiating or walking away

When can you still walk away after a bad survey in England and Wales?

Usually before exchange, because that is when you become legally committed, unless you have already signed something that binds you, such as some reservation agreements on a new build. RICS tells you to get written quotations for rating 3 repairs before legal commitment. It does not force you to stay, and it does not force the seller to cut the price. Your solicitor confirms this contract.

Last reviewed 24 October 2026. Written for buyers in England and Wales unless this answer says otherwise. No named surveyor has signed this page. It is general guidance, not a report on your house, and not legal advice.

What is the fuller explanation?

Walking away costs you the survey fee and any other costs you agreed. It is not free of loss. It is free of the house. After exchange, a gloomy survey is not a standard right to undo the contract. Do not instruct the survey so late that the report arrives after you are bound, unless you have decided to take that risk.

Scotland’s process is different. Do not use this English timing for a Scottish missive. Ask the Scottish solicitor. A Home Report is meant to be read before you are committed under that system. RICS says a purchaser can rely on that pack. Reliance still does not turn a condition comment into the missives.

What should you ask your surveyor?

  • Which findings are you saying should be quoted before I commit?
  • Are you advising me to withdraw? Please do not. That is my decision.
  • What was not inspected that I would be walking away without knowing?

What are the typical next steps?

  1. Speak to your solicitor before you tell the agent you are withdrawing.
  2. If you stay, get the quotes first so the decision is priced.
  3. Do not refuse to exchange and keep negotiating forever without a date. The seller can sell elsewhere.

Costs vary with the building and with who you instruct. Where this page does not cite a published figure, ask the surveyor, a relevant specialist, or your solicitor for a written quote. Do not treat a forum average as the price.

Does a rating 3 oblige you to walk?

No. It obliges you to take it seriously and, in RICS’s Level 3 wording, to get quotes before commitment. You may still buy.

Can the agent keep your reservation fee?

If you paid one, the agreement says. It is not a survey rule. Ask the solicitor to read it.
