Leasehold
Can the owner of a leasehold house use the Right to Manage GOV.UK describes for blocks of flats?
Not on the qualifying guide’s own test. It says the building must be made up of flats, and that houses do not qualify. A leasehold house can still have a ground rent, a lease and a freeholder. A home survey does not convert the house into a block, and it does not run a Right to Manage claim.

What is the fuller explanation?
Leasehold houses are a tenure question for the solicitor: length of lease, ground rent, and what the freeholder still controls. The survey is the bricks, the roof and the drains. Mixing them produces nonsense demands, such as asking a house surveyor for an RTM company search. The guide’s other tests, including the two-thirds leasehold test and the residential floor area, are for buildings of flats. They are not a checklist for a semi.
If the house is a converted building with several flats, that is a block, and the guide’s tests might matter. A single house is not that building. There is no survey fee that includes incorporation of a company. Do not delay a house purchase for an RTM process the guide says does not apply.
What should you ask your surveyor?
- Is this a house, or a building of flats?
- Are you commenting on tenure? You should say if you are not.
- Which lease questions are you leaving to the solicitor?
What are the typical next steps?
- Ask the solicitor about the house lease. Do not ask them to start a flat RTM.
- Read the survey for the building, whoever the freeholder is.
- If you are buying a flat in a conversion, then ask the qualifying questions. Do not ask them for a detached house.
Costs vary with the building and with who you instruct. Where this page does not cite a published figure, ask the surveyor, a relevant specialist, or your solicitor for a written quote. Do not treat a forum average as the price.

Does a leasehold house still need the ground-rent questions?
Yes. Those come from the lease and the ground-rent law. They are not cancelled because RTM does not apply.
Is a maisonette a house for this test?
Do not guess. The guide is about buildings of flats. Ask the solicitor what this building is before anyone talks about a company.
