Party walls and boundaries

The neighbour has already started a loft, and a steel is visible in this loft against the party wall. Does the survey know notice was served?

No. The survey can see a beam or a bearing on this side of the wall, but it cannot see the neighbour’s paperwork and does not know whether notice was served. GOV.UK’s party-wall rules apply in England and Wales, not in Scotland or Northern Ireland, and the home survey does not serve notice or make an award.

What is the fuller explanation?

Work to a party wall is one of the things GOV.UK says can fall under the Act, including work that affects the wall you share. A steel appearing in your loft means something has already been done, or is being done, at that wall. The condition question is what the surveyor could see: a padstone, a cut into the wall, new cracks, or only the end of a beam. The legal question is whether the procedure was followed. Those questions do not answer each other.

Your solicitor asks the seller what they know and what they hold. The surveyor should not guess that the neighbour “must have had consent” because the steel looks tidy. Planning permission, if the neighbour had it, does not replace the Act. Do not serve a notice yourself by forwarding the survey. In Scotland or Northern Ireland, do not use this English and Welsh procedure at all. Ask a solicitor there.

What should you ask your surveyor?

  • What exactly can you see of the steel and the wall on this side?
  • Did you see inside the neighbour’s loft?
  • Are you stating that notice was served?

What are the typical next steps?

  1. Tell your solicitor a steel is already in place. Ask what papers exist.
  2. Use the survey for cracks and bearings on this side only.
  3. Do not apply the English and Welsh Act to a Scottish or Northern Irish purchase.

Costs vary with the building and with who you instruct. Where this page does not cite a published figure, ask the surveyor, a relevant specialist, or your solicitor for a written quote. Do not treat a forum average as the price.

Also asked about this

Does a tidy bearing mean the work was agreed?

No. Neat steel is not notice. The survey cannot see the agreement.

Is this the same as a beam you plan to put in later?

No. This steel is already there from the neighbour’s work. Future work of your own would be a separate question.
