Leasehold
When did the peppercorn ground-rent rule start for retirement homes?
GOV.UK says the Leasehold Reform (Ground Rent) Act 2022 came into force on 30 June 2022 for most new leases, and not before 1 April 2023 for retirement properties. A retirement flat sold under a lease granted before that later date can still reserve a real ground rent. The survey does not tell you which date this lease was granted.

What is the fuller explanation?
Retirement developments are often leasehold and often come with a service charge and an event fee or exit fee that sits in the lease, not in the roof covering. None of that appears in a moisture meter reading. The Act’s peppercorn limit is about ground rent on leases it covers. It is not a cap on service charges. GOV.UK’s leasehold pages are where service charges and the right to challenge them are explained.
Ask the solicitor for the lease date, the rent, and any fee payable on sale or subletting. Ask the surveyor about the building. If you mix those reports you will either overpay for a legal problem or ignore a leaking flat roof. This page will not guess a typical retirement exit fee.
What should you ask your surveyor?
- What in your report is about the building rather than the lease?
- Did you see anything in the common parts that a buyer should budget to repair through the service charge?
- What must the solicitor confirm about the date of the lease?
What are the typical next steps?
- Have the solicitor check whether this retirement lease is inside the peppercorn rule or predates it.
- Read the service charge and any exit fee separately from ground rent.
- Use the survey for the fabric, including common parts the surveyor was able to see.
Costs vary with the building and with who you instruct. Where this page does not cite a published figure, ask the surveyor, a relevant specialist, or your solicitor for a written quote. Do not treat a forum average as the price.

Does the later start date mean retirement leases can still charge rent forever?
It means the Act did not apply to those leases before 1 April 2023. What this lease reserves is a question for the document. Ask the solicitor.
Is an exit fee a service charge?
Not by name. It is whatever the lease says it is. GOV.UK explains service charges in their own right. Ask the solicitor to label each charge correctly.
