Age and type of house

What should you ask if the only access to a mews house is across a yard the survey cannot give you?

Ask the solicitor who owns the yard and whether you have a right to cross it. The survey can describe the surface, the drain and the wall. It cannot grant a right of way, and it cannot turn a pretty cobble into a title. A party-wall note is a different thing again. GOV.UK’s party-wall guidance is about certain works, not about whether you may drive home.

What is the fuller explanation?

Mews houses often sit over or beside old stables, with shared drains and walls of different owners. The home survey sees cracks, roofs and damp. HM Land Registry and the deeds are where rights are looked for, and even the plan is not always the whole answer. The survey should not say “access is fine” because the gate was open on the day.

If the yard drains onto your wall, that is a condition comment. Who must clear the gulley is a legal comment. A survey fee does not buy a right of way. Do not negotiate a roof reduction because the yard is shared. Negotiate, if at all, with the right paper.

What should you ask your surveyor?

  • What did you see in the yard, and what did you not know about its ownership?
  • Does any defect on this house depend on that shared surface?
  • Are you leaving access rights to the solicitor?

What are the typical next steps?

  1. Ask the solicitor about the yard before you plan to park on it.
  2. Keep drain defects and access rights in separate notes.
  3. Do not block a shared gulley because you prefer a flower pot.

Costs vary with the building and with who you instruct. Where this page does not cite a published figure, ask the surveyor, a relevant specialist, or your solicitor for a written quote. Do not treat a forum average as the price.

Also asked about this

Is a mews automatically leasehold?

No. Tenure is the deed. The building type is not the lease.

Does a shared wall mean a party-wall award already exists?

No. An award is a document. The survey has not produced one.
