Leasehold

You might later become a director of the RTM company. Does the home survey appoint you or list those duties?

No. Becoming a director later would be a company appointment, with duties that come from the RTM company and from company law, not from the inspection. The home survey does not appoint you, does not list those duties, and does not count the flats or sign any membership form. It remains a report on the building the surveyor was able to see.

Last reviewed 24 October 2026. Written for buyers in England and Wales unless this answer says otherwise. No named surveyor has signed this page. It is general guidance, not a report on your house, and not legal advice.

What is the fuller explanation?

Right to Manage lets qualifying leaseholders take over management of the building without the landlord agreeing and without proving that management has been bad. The landlord still owns the building. The RTM company collects the service charge and looks after communal areas and structure, for example the roof. It may manage directly or hire an agent. None of that paperwork is done by the surveyor on the morning they inspect a flat. They do not appoint directors, and they do not explain a director's duties in the ratings.

If you are thinking of joining the board, ask the company for its articles, its accounts and what the directors actually do week to week. The landlord may be a member, but its votes are capped at one third of the leaseholders' votes. That cap is a voting rule, not a survey finding. Use the report to understand the roof, the stairs and the damp. Use a solicitor or the company's own papers to understand the job you might be taking on. The two should sit side by side, not be collapsed into one PDF.

What should you ask your surveyor?

  • Are director duties outside your instructions? They should be.
  • Which building risks would a new director still need to read in this report?
  • Did you count membership or only inspect the flat?

What are the typical next steps?

  1. Read the RTM company's own papers before you agree to be a director.
  2. Do not look in the survey for an appointment or a list of duties.
  3. Keep the roof findings for the building, and the voting rules for the company.

Costs vary with the building and with who you instruct. Where this page does not cite a published figure, ask the surveyor, a relevant specialist, or your solicitor for a written quote. Do not treat a forum average as the price.

If the block is already under Right to Manage, are you a director by buying?

No. Buying the flat does not appoint you. Membership and directorship are company steps the survey never takes.

Does the survey cap the landlord's votes?

No. The cap is in the Right to Manage rules. The survey does not count votes or apply the cap.
