Renegotiating or walking away

You decide to walk away before exchange in England. Which fees does that decision not automatically return?

It does not automatically return the fee you paid the surveyor you instructed. Choosing not to buy before exchange in England means you are not yet legally committed to that purchase. It is not a refund scheme for the report, and it is not a claim against the seller for your costs. Ask each person you have paid what their own terms say. What to do now advises you. It does not bill the seller for the survey fee.

What is the fuller explanation?

Buyers hear that they can still walk away before exchange and then expect every invoice to reverse. The survey fee was for the inspection and the report you asked for. Unwelcome news is not, by itself, a failure to deliver that report. A condition rating 3 means the element is serious and/or urgent and that you should obtain written quotations before legal commitment. If you decide the quotations, or the defect, are more than you will take on, you may choose not to proceed while you are not committed. That choice does not write a refund into the surveyor's terms.

Other payments depend on the contracts that created them. This note will not invent a list of sums that always come back or never come back. Ask the solicitor about their own fees, and ask the lender or broker about any application costs, without treating those questions as survey questions. What to do now is advice to the buyer about the report. It does not invoice the seller, and it does not transfer your professional fees to them because you changed your mind. Keep the decision not to buy separate from the hope that somebody else will pay for the information.

What should you ask your surveyor?

  • Which findings made you decide not to proceed?
  • Did you already obtain the written quotations the rating 3 pointed to?
  • Is any part of the report unfinished, as against simply unwelcome?

What are the typical next steps?

  1. Tell the solicitor you do not intend to exchange.
  2. Ask the survey firm what their terms say about the fee already charged.
  3. Do not ask the seller to refund your survey as if the rating required it.

Costs vary with the building and with who you instruct. Where this page does not cite a published figure, ask the surveyor, a relevant specialist, or your solicitor for a written quote. Do not treat a forum average as the price.

Does walking away before exchange cancel the purchase automatically?

You are not yet committed if you have not exchanged. Confirm that with the solicitor before you rely on it.

Does a rating 3 compel you to leave?

No. It does not order you to withdraw. It tells you to get written quotations before legal commitment.
