Leasehold
Does the peppercorn rule for newer leases rewrite a doubling ground-rent clause already written into a 2016 lease?
No. A doubling clause in a lease granted in 2016 is still in that lease, and the Leasehold Reform (Ground Rent) Act 2022 does not rewrite existing leases. A home survey looks at the flat. It does not delete the rent clause or replace it with a peppercorn.

What is the fuller explanation?
GOV.UK explains that the peppercorn rule is for most new long residential leases in England and Wales from 30 June 2022. Retirement homes were not brought into that rule before 1 April 2023. A lease dated 2016 was already granted, so it sits with the leases the Act left alone. Whatever timetable of increases the lease actually reserves is for your solicitor to read in the document. Do not treat a forum post as a ban on doubling, and do not ask the surveyor to cross the clause out.
The inspection can still matter. It tells you about the roof, the damp and the services that were seen. None of that changes the rent. Ask the solicitor to set out what the lease says will happen to the ground rent, and when, and to keep that note away from the condition ratings. There is no survey formula that converts a doubling clause into a repair cost, and you should not invent one.
What should you ask your surveyor?
- Are you silent on the ground rent clause? You should be.
- Which building defects would still matter if the rent clause is onerous?
- What should the solicitor read that was not in the inspection?
What are the typical next steps?
- Give the solicitor the lease, not a paraphrase of the rent review.
- Do not tell the lender the 2022 Act has cancelled a 2016 doubling clause.
- Keep the rent note and the condition ratings in separate columns.
Costs vary with the building and with who you instruct. Where this page does not cite a published figure, ask the surveyor, a relevant specialist, or your solicitor for a written quote. Do not treat a forum average as the price.

Does a survey sentence about the block cancel the rent?
No. Condition and ground rent are different. A rating on the roof does not amend the lease.
If the lease is extended later, does this visit decide the new rent?
No. Any extension is a legal step. The survey does not write the new lease or the rent on it.
