Can you treat a condition rating as a tribunal challenge to a service charge?

No. A condition rating is the surveyor’s opinion of an element for the person who bought the survey. GOV.UK says you may be able to ask a tribunal if a charge is unreasonable, the work was unsatisfactory, or you do not think you should pay it, and that you cannot do that if you have already agreed the charge. The rating is not the application and not the agreement.

What is the fuller explanation?

Use the survey, if it describes the work, as evidence of what the building is like. Then ask a solicitor or the Leasehold Advisory Service, which is who GOV.UK points you to, about the tribunal. England and Wales are not the same body on that page. A buyer who has not yet completed may not even be the leaseholder who can apply. Do not file the PDF and call it a claim.

There is no RICS fee for a tribunal, and no rule that a rating 3 cancels a service charge. If you are still buying, the decision is whether you want the flat with this roof and these accounts. That is a purchase decision. It is not a judgment.

What should you ask your surveyor?

  • Does your report describe the work the charge is for, or only the element?
  • Are you suggesting I start a claim? Please leave that to a solicitor.
  • Which facts are condition, and which papers did you not see?

What are the typical next steps?

  1. Do not file a tribunal claim yourself from a rating.
  2. If you have already agreed a charge, tell the solicitor before you assume you can reopen it.
  3. Decide the purchase with the survey and the accounts, not with a hoped-for refund.

Costs vary with the building and with who you instruct. Where this page does not cite a published figure, ask the surveyor, a relevant specialist, or your solicitor for a written quote. Do not treat a forum average as the price.

Does GOV.UK say every charge can be challenged?

No. It sets out when you may apply and when you cannot, including if you have agreed to pay. Read that page.

Can the surveyor appear as your expert?

Only if they agree a separate instruction. The buyer’s survey is not an automatic expert report.
