Leasehold

Can a home survey tell you the ground rent the lease reserves?

No. Ground rent is a clause in the lease. The surveyor does not read that clause as part of a visual inspection, unless a separate legal review was agreed, which would be unusual and would appear in the terms. Any rent figure in a survey is only repeating what someone else told them, if they repeat it at all.

What is the fuller explanation?

Use the survey for the building and the solicitor for the rent, the reviews and the service charge. Government guidance on the 2022 Act explains the peppercorn rule for new leases. Older leases need reading. A condition rating 1 on the hallway does not mean the rent is a peppercorn.

If the particulars state a rent, treat it as a claim to be checked. Send it to the solicitor. Do not ask the surveyor to confirm it after the inspection. They did not see the lease. Lenders care about some rent patterns. Ask the lender with the clause in front of you, not with the brochure.

What should you ask your surveyor?

  • Did the seller or the agent state a rent that you then wrote down? If so, say it was not verified.
  • Which physical issues could affect a service charge even though they are not the ground rent?
  • Where in the report do you tell me to take legal points to a solicitor?

What are the typical next steps?

  1. Verify the rent on the lease.
  2. Verify the building on the survey.
  3. Do not let one document answer the other document’s question.

Costs vary with the building and with who you instruct. Where this page does not cite a published figure, ask the surveyor, a relevant specialist, or your solicitor for a written quote. Do not treat a forum average as the price.

What if the survey prints a ground rent and it is wrong?

The lease wins. Tell the solicitor. Surveyors can mistype a figure they were given. It is still not their job to set the rent.

Does a freehold house have ground rent?

A freehold house normally does not. A managed estate can still have a rentcharge or an estate charge. Ask the solicitor. Do not use the leasehold answers on a freehold without that check.
